Abstract From the Canadian patent

A biscuit adapted to be ingested by a patient to enable measurement of gastric emptying was added prior to baking Spirulina Platensis alga grown in a 13CO2 atmosphere. These single cell organisms are oxidized after digestion in the small intestine to produce a detectable rise in level of 13CO2 in the patient's breath which is sampled and plotted to enable diagnosis of abnormal gastric emptying rates.

Why it's free to use

  • Filed January 10, 1997 and granted May 8, 2001. A Canadian patent filed from October 1, 1989 lasts 20 years from filing, so its term ended January 10, 2017.
  • A certificate of supplementary protection adds at most two years for a drug, so even that would have ended by January 10, 2019.
  • We check Canadian rights only. A patent in its family in another country could still be in force: check its family on Google Patents.
