Abstract From the Canadian patent

A marking instrument, e.g. a fibre tip pen roller ball pen, or highlighter pen, has a feed device which conducts marking liquid from the reservoir chamber (17) to the marking tip supported by an elastomeric diaphragm (6) which partly confines the reservoir chamber and forms a valve with the feed device so that when the tip is applied against a surface the feed device retracts causing the diaphragm (6) to pressurise the liquid in the reservoir and open the valve whereby liquid is pumped to the tip.

Why it's free to use

  • Filed September 15, 1992 and granted September 15, 1998. A Canadian patent filed from October 1, 1989 lasts 20 years from filing, so its term ended September 15, 2012.
  • A certificate of supplementary protection adds at most two years for a drug, so even that would have ended by September 15, 2014.
  • We check Canadian rights only. A patent in its family in another country could still be in force: check its family on Google Patents.
